PayWise+ Product Specific Terms
These Product Specific Terms are supplementary to the Core Terms and apply where You buy PayWise+ from Us. They form part of the Agreement. Where a capitalised word is used in these terms but is not defined here, it has the meaning given to it in the Core Terms.
1. Definitions
User — any employee or worker of the Customer who is authorised to access and use PayWise+ for the purposes set out in this Agreement.
User Transaction — the payment made by Us to a User as a result of a User request to draw down accrued salary. A User Transaction is a variable consumed service.
2. Terms
2.1 In addition to Our other rights in the Core Terms, We may suspend access to PayWise+ where invoiced User Transactions remain unpaid for seven days.
2.2 Credit risk check. Use of PayWise+ is subject to a satisfactory credit risk assessment. We may carry out a credit check on You before any Services commence. We will not provide access or deliver services until this check is completed to Our satisfaction. If, in Our reasonable opinion, the results are unsatisfactory, We may withhold the PayWise+ Services or cancel the Agreement without liability.
2.3 Tracking feature. The PayWise+ app may give Users access to information about their accrued gross earnings to date. This is provided for information only. We do not warrant that it is complete or accurate at all times, and it should not be relied on as a substitute for payroll records.
2.4 Savings Pots. Users may choose to allocate funds into 'Savings Pots' within the PayWise+ app. Savings Pots are operated in partnership with Our third-party banking partner (a regulated financial institution). All funds held in Savings Pots are the responsibility of that banking partner and subject to its terms and conditions. PayWise+ does not itself hold or safeguard any client monies, and We are not liable for any act or omission of the banking partner in relation to the Savings Pots.
2.5 AI chatbot (Penny). The PayWise+ app includes an AI chatbot ('Penny') that provides general financial guidance and information only. Penny is an AI Service for the purposes of the AI Terms which are incorporated and apply to the use of Penny in full. The following apply in addition to, and without prejudice to, those terms; if there is any conflict between this clause and the AI Terms, this clause prevails:
(a) Penny does not provide personalised financial advice, investment advice, tax advice or any other regulated financial services. We are not regulated by the Financial Conduct Authority or any other financial-services regulator in respect of the AI chatbot functionality;
(b) all information provided through Penny is educational only. You must ensure Users are aware that information from Penny must not be relied on as the sole basis for any financial decision, may not suit a User's specific circumstances, and that Users should seek independent professional advice before acting on it; and
(c) without prejudice to the AI Terms, Penny is provided 'as is' and We make no warranty as to the accuracy or completeness of any information it provides. You acknowledge that AI systems may produce outputs that are inaccurate, incomplete or inappropriate.
2.6 You must ensure Users are aware of the limitations in clause 2.5, and You are responsible for each User's use of Penny in accordance with this Agreement.
2.7 User discretion. The features in clauses 2.3 to 2.5 are made available at Users' discretion. We do not guarantee that all Users will have access to or use them, and their use does not affect Your obligation to pay the applicable Fees.
